This privacy notice for Utility Associates, Inc. (“we,” “us,” or “our“), describes how and why we might collect, store, use, and/or disclose (“process“) your information when you use our services (“Services“), such as when you:

  • Visit our website at https://www.utility.com/, or any website of ours that links to this privacy notice
  • Engage with us in other related ways, including any sales, marketing, business meetings, or events

We collect the following types of personal data through our Services:

Information provided by you online and offline:

  • Identification and contact information: such as your name and surname, title, User ID (e-mail address), password, postal address, email address, telephone numbers, or other contact details information you may provide to us
  • Information you provide about a third party:name, surname, address and contact details of recipient for delivery of goods or services, if different from yours
  • Preference information: your account settings, your wishlist, your preferred contact channel, and the types of services/offers that interest you
  • Other voluntary information: any voluntary information you may provide us in the course of your interactions with us (such as by sending an e-mail or by calling, e-mailing, texting, or chatting online with our Customer Service team or by responding to surveys or competitions)

Information collected from consumer and/or automatically from consumer’s devices:

  • Sensitive personal information:  such as precise geolocation (if you permit us to obtain your precise geolocation), combination of email address, with security or access code, password, or other credentials allowing access to your account
  • Log and Usage Data:  service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, links that are clicked, the keystrokes typed, movement of the mouse or pointer, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).
  • Device Data: such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data:  such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device.  However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Information collected from third parties:

  • Legal information: fraud checks or flags raised about your transactions, payment card refusals, suspected crimes, complaints and/or claims
  • Social Media Information:if you interact with us through a social media service or log in using social media credentials, depending on your social media settings, we may have access to your information from that social network such as your name, email address, age, gender, and location

We may also drawinferences from the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences.   • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more.
  • To post testimonials. We post testimonials on our Services that may contain personal information.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
  • To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

Cross-border transfer

Our Services, including our websites, may be hosted in the United States. If you are visiting the Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries in accordance with this Privacy Policy. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country.  Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions.  By using the Services and/or providing personal information to us, you consent to transfer of your information to our facilities as described in this Privacy Policy.

Vendors, Consultants, and Other Service Providers. We may disclose your data to third-party vendors, service providers, contractors, or agents (“third parties“) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct. The categories of third parties we may share personal information with are as follows:

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). We obtain and store on your device (“cache”) your location for twelve (12) months. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.

We may use cookies and similar tracking technologies (like web beacons, pixels, and tags) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy.

We will only keep your personal information for as long as it is necessary for the purposes for which it was collected, as set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).  When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We have implemented appropriate and reasonable administrative, technical, and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee the safety of your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

We are a business-to-business service, so we do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. We do not have actual knowledge about selling or sharing personal information of consumers under the age of 18.  If you become aware of any data we may have collected from children under age 18, please contact us at info@utility.com.

Withdrawing your consent

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Cookies and similar technologies

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services.

California Residents

If you are a California resident, you have additional privacy rights with respect to your Personal Information, pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”).  California law provides you with the following rights with respect to your personal information:

  • The right to know what personal information we have collected, used, or disclosed about you.
  • The right to request that we delete personal information we have collected about you.
  • The right to correct inaccurate personal information about you.
  • The right to opt out of the selling or sharing of your personal information, which you can exercise through the DSAR contact form available on our website or by info@utility.com and submit a data subject access request.  We will endeavor to honor such requests unless such a request conflicts with certain lawful exemptions under California’s consumer privacy law. Please note that we are only required to honor requests to know twice in a 12-month period.

    Verification process

    Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

    We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying your identity.

    Additional Terms

    We do not discriminate against California residents who exercise any of their rights described in our Privacy Policy. Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.

    This Privacy Policy describes how we may share your information for marketing purposes, as described above. If you are a California resident, the Shine the Light law permits you to request and obtain from us once per calendar year information about any of your personal information shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. To request this information and for any other questions about our privacy practices and compliance with California law, please contact us through the contact form on our website.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

We are working towards enabling Global Privacy Control (GPC) as an additional way for you to submit a request to opt out of the sale and sharing of your personal information through browsers and/or browser extensions that support such a signal.  Until then, you can opt out of the use of third-party cookies for personalized advertising by setting your cookie preferences on our website or on your browser

We may update this privacy notice from time to time. The updated version will be indicated by a new date at the top of the policy, and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by directly sending you a notification and/or by prominently posting a notice of such changes. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
